Terms of Service
Effective date: October 20, 2026
Who We Sell To
Tacstix LLC sells to law enforcement agencies, military units, other government agencies, approved dealers and resellers, and other qualified buyers. A "qualified buyer" is a person or organization that we have verified as having a legitimate professional or training need for the product, such as a sworn officer, a member of the armed forces, or a professional security or training organization. Some products, including the Battering Ram "Surge," are sold only to agencies, approved dealers, and qualified buyers whose purchase we have verified. General merchandise, such as stickers, may be sold to the public.
Before we fill an order, we may ask for your agency or company name, your role, proof of employment or authorization, and other contact details to confirm that you are eligible to buy. We may cancel and refund any order that we cannot verify.
Overview
The terms "we," "us," and "our" refer to Tacstix LLC, a California limited liability company based in San Diego, California. Tacstix LLC operates this store and website, including all related information, content, features, tools, products, and services (the "Services"). Our store is hosted on Shopify, which provides the platform that lets us offer the Services to you.
These terms, together with the policies they reference, including our Privacy Policy, Refund Policy, Shipping Policy, and Limited Lifetime Warranty (together, these "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully. They include warranty disclaimers and limitations of liability.
By visiting, interacting with, or using the Services, or by placing an order, you agree to these Terms. If you do not agree, do not use the Services. If you place an order on behalf of an agency, company, or other organization, you confirm that you are authorized to bind that organization to these Terms. These Terms do not limit any rights you have under applicable consumer protection laws or other rights that cannot be waived by contract.
1. Access and account
You represent that you are at least 18 years old and the age of majority where you live. To use the Services or buy products, you may be asked to provide information such as your name, agency or company, email address, phone number, billing, payment, and shipping information. You represent that all information you provide is correct, current, and complete. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.
2. Our products
We work to describe and show our products accurately. Colors and appearance may look different on your screen depending on your device and settings. Product descriptions, specifications, and availability may change without notice. We may discontinue any product at any time and may limit quantities offered to any person, organization, region, or jurisdiction.
All Tacstix products are designed and made in the USA.
3. Orders
When you place an order or submit a quote request that we accept, you are making an offer to buy and you authorize us and our payment processors to charge your selected payment method, or to invoice your agency under an accepted purchase order, for the total amount of your order. We may accept or decline any order for any lawful reason, including if we cannot verify eligibility. Your order is not accepted until we confirm acceptance. If we decline, change, or cancel an order, we will try to notify you using the email, phone number, or address you gave us, and we will refund any amount we collected for the canceled portion.
Your purchases may be returned or exchanged only as described in our Refund Policy and Limited Lifetime Warranty, except where applicable law gives you additional rights.
Approved dealers and resellers may resell Tacstix products under their written dealer agreement with us. Unless you are an approved dealer, you represent that you are buying for your own use or for use by your agency or organization and not for resale. No buyer may resell or transfer restricted products, including the Battering Ram "Surge," to anyone who is not a law enforcement, military, or government agency, an approved dealer, or a qualified buyer.
4. Prices and billing
Prices, discounts, and promotions may change without notice. The price charged is the price in effect when your order is placed, as shown in your order confirmation or accepted quote. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import charges. Promotions may have their own terms; if a promotion's terms conflict with these Terms, the promotion's terms govern for that promotion. You agree to provide current, complete, and accurate purchase and payment information and to keep it updated. You represent that you are authorized to use the payment method you provide and that you will pay all charges at the posted prices, including shipping, handling, and applicable taxes. Quotes issued to agencies are valid for 90 days unless the quote states otherwise.
5. Shipping and delivery
We currently ship only to addresses in the United States (including Alaska, Hawaii, U.S. territories, and APO/FPO/DPO military addresses) and Canada. Canadian buyers are responsible for any duties, taxes, brokerage, and import fees charged on delivery. Delivery times are estimates and are not guaranteed. To the extent permitted by law, title and risk of loss pass to you when we hand the products to the carrier, unless we deliver them ourselves, in which case they pass on delivery. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, severe weather, labor disputes, supply shortages, utility or telecommunications outages, cyber incidents, or government action. See our Shipping Policy for details.
6. Export controls
Our products are intended for use in the United States and Canada. We do not ship, and you may not export, re-export, or transfer, any Tacstix product outside the United States and Canada without our prior written approval. You are responsible for complying with all applicable U.S. export control and sanctions laws and Canadian import laws, including for any shipment to Canada and any export we approve. U.S. laws include the Export Administration Regulations, the International Traffic in Arms Regulations where applicable, and regulations administered by the Office of Foreign Assets Control. You are also responsible for obtaining any required licenses. You represent that you are not on any U.S. government restricted or denied party list and that you will not transfer any product to anyone who is.
7. No modification
Do not modify, alter, machine, cut, drill, weld, heat, or otherwise change any Tacstix product, and do not use a product with parts or accessories that we did not supply or approve. Modification can make a product unsafe and voids our Limited Lifetime Warranty for that product. To the extent permitted by law, we are not responsible for any injury, loss, or damage caused by a modified product.
8. Battering Ram "Surge" and other breaching tools
The Battering Ram "Surge" is a breaching tool for trained personnel only. It is sold only to law enforcement, military, and government agencies, approved dealers, and qualified buyers. By buying it, you represent that it will be used only by personnel who are trained in manual breaching, who follow their agency's policies and applicable law, and who wear appropriate protective equipment. You are responsible for training, supervision, inspection, and lawful use. Read and follow the warnings and use instructions provided on the product page and with the product.
9. Intellectual property
The Services, including all trademarks, text, images, graphics, product designs, videos, and audio, are owned by Tacstix LLC or its licensors and are protected by U.S. and foreign intellectual property laws. Tacstix room markers are protected by U.S. Design Patent No. D1,062,984, and other patents are pending. Buying or receiving a product does not give you any patent, copyright, trademark, or other intellectual property right in the product or its design. You may use the Services for your own internal business, agency, training, or personal purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit material from the Services, or copy or reverse engineer our product designs, without our prior written consent. The Tacstix name, logos, product names, designs, and slogans are trademarks of Tacstix LLC and may not be used without our written permission.
Axon, Busch, and 3M are trademarks of their respective owners. Tacstix is not affiliated with or endorsed by them. Other product and company names on the Services are trademarks of their respective owners and are used only to describe product compatibility.
10. Optional tools
We may give you access to third-party tools that we do not monitor or control. We provide these tools "as is" and "as available," without warranties or endorsement. Your use of them is at your own risk and is subject to the third party's terms. New features or tools we add to the Services are also subject to these Terms.
11. Third-party links
The Services may contain links to third-party websites or content. We are not responsible for third-party content, products, services, or practices. If you use a third-party site, you do so at your own risk and under that party's terms and policies.
12. Relationship with Shopify
Our store is hosted on Shopify. When you use the Services, your device communicates with Shopify's systems. All sales are made directly between you and Tacstix LLC. Shopify is not responsible for any aspect of those sales.
13. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you acknowledge that you have read it.
14. Feedback
If you send us ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that Feedback for any purpose. You represent that you have the right to give it to us and that it does not violate anyone's rights or any law. We are not required to keep Feedback confidential, pay for it, or respond to it, and we may remove Feedback that we consider unlawful, offensive, or in violation of these Terms.
15. Errors, inaccuracies, and omissions
The Services may occasionally contain errors in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors and update information, and we may cancel orders affected by an error, including after an order is submitted. If we cancel an order after payment, we will refund the amount paid for the canceled portion.
16. Prohibited uses
You may use the Services only for lawful purposes. You may not use the Services or our products: (a) for any unlawful purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property or anyone else's; (d) to harass, threaten, or harm any person; (e) to provide false or misleading information, including false eligibility information; (f) to send spam or unsolicited promotions; (g) to impersonate any person or organization; (h) to upload viruses or malicious code; (i) to collect personal information about others; (j) to use robots, scrapers, or other automated means to access the Services except as allowed in Section 17; or (k) to bypass any security or access control. We may suspend or end your access if you violate these Terms.
17. Agents
This section applies if you use, allow, or deploy any software or service that takes autonomous or semi-autonomous action on your behalf (an "Agent") to access the Services. An Agent may access the Services only if it identifies itself in every HTTP or HTTPS request by including "Agent/[agent name]" in its user agent string, does not conceal that it is an Agent, does not complete or circumvent CAPTCHAs or similar measures, answers truthfully if asked whether it is a human or a computer, and does not circumvent any measure we use to limit or control Agent access. We may limit or block Agent access at any time.
18. Termination
We may end these Terms or your access to the Services at any time. You remain responsible for all amounts owed through the date of termination. Sections that by their nature should survive termination will survive, including those on intellectual property, export controls, no modification, warranty disclaimer, limitation of liability, indemnification, and governing law.
19. Disclaimer of warranties
Information on the Services is provided for general information. Product use guidance on the Services does not replace professional training or your agency's policies.
EXCEPT AS STATED IN OUR LIMITED LIFETIME WARRANTY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY OTHER EXPRESS WARRANTY. ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE TERM OF THE LIMITED LIFETIME WARRANTY, AND WE DISCLAIM IMPLIED WARRANTIES ENTIRELY WHERE THE LAW ALLOWS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.
20. Limitation of liability
EXCEPT AS STATED IN OUR LIMITED LIFETIME WARRANTY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, TACSTIX LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR ANY PRODUCT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL INJURY, GROSS NEGLIGENCE, VIOLATION OF LAW, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING CALIFORNIA CIVIL CODE SECTION 1668. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tacstix LLC and its members, managers, employees, agents, contractors, and suppliers from third-party claims, losses, damages, and liabilities, including reasonable attorneys' fees, arising from (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, (3) your modification or misuse of any product, or (4) use of a product by personnel who are not trained or authorized. We will notify you of any claim, and you will cooperate in its defense. We will not settle a claim that requires you to do something other than pay money without your consent, which you will not unreasonably withhold.
22. Governing law and venue
These Terms, and any dispute arising from or related to these Terms, the Services, or any product, are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any lawsuit must be brought only in the state or federal courts located in San Diego County, California, and you and Tacstix LLC consent to personal jurisdiction and venue in those courts. This section does not limit any non-waivable right you may have to bring a claim in another forum or under the mandatory laws of your state. If you are a government agency and a law that applies to you requires a different governing law or forum, that law controls to the extent required.
23. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will stay in effect.
24. Waiver; entire agreement
Our failure to enforce any right or provision is not a waiver. These Terms and the policies they reference are the entire agreement between you and us about the Services and replace any prior agreements on the same subject. A signed dealer agreement, government contract, or accepted purchase order that conflicts with these Terms controls to the extent of the conflict.
25. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without notice to you.
26. Electronic communications
By using the Services or placing an order, you agree that we may send you transactional and service communications electronically, including by email or text message where you have given us your number. You are responsible for keeping your contact information current.
27. Changes to these Terms
We may update these Terms by posting a new version on this page with a new effective date. Changes apply to orders placed after the update is posted. Your continued use of the Services after the update means you accept the updated Terms.
